
TERMS AND CONDITIONS
1. General Terms
1.1 These Terms and Conditions (“T&Cs”) govern all services and pricing provided by BIM 3D Scanning Services (“the Company”).
1.2 By engaging the Company’s services or renting equipment, the Client agrees to these T&Cs in full.
1.3 The Company reserves the right to update these T&Cs at any time without prior notice. Updated versions will be posted on the Company’s website and will apply to all transactions thereafter.

2. Services
2.1 The Company offers 3D scanning, virtual tours, 3D modeling, as-built documentation, and other related services using Matterport technology.
2.2 All services are provided on a best-effort basis. While every effort is made to ensure accuracy, the Company is not liable for errors resulting from:
* Client-provided inaccurate or incomplete information.
* Environmental conditions affecting the scanning process (e.g., poor lighting, reflective surfaces, or access limitations).
2.3 Clients are responsible for ensuring the property is prepared for scanning (e.g., tidy and accessible).

3. Pricing
3.1 Prices are subject to change without notice and may vary based on:
* Property size or complexity.
* Unique property features requiring additional time or resources.
* Locations outside of Somerset West, which may incur additional travel charges.
3.2 Estimates provided before booking are subject to review and adjustment after an on-site assessment or further discussions with the Client.

4. Payment Terms
4.1 A deposit of 50% is required to confirm any booking. The remaining balance is due within 7days of service completion or upon delivery of results, whichever occurs first.4.2 Late payments may incur interest at a rate of 2% per month.4.3 All payments must be made via EFT to BIM 3D Scanning Services (Pty) Ltd bank account.

5. Cancellations and Rescheduling
5.1 Cancellations made less than 48 hours before the scheduled service will forfeit the 50% deposit.5.2 Rescheduling requests will be accommodated where possible but may incur additional charges.

6. Liability
6.1 The Company is not responsible for any:
* Damage to property resulting from the Client’s failure to prepare the space adequately.
* Delays caused by factors beyond the Company’s control (e.g., extreme weather, access restrictions, or equipment failure).6.2 The Client acknowledges that 3D scans and virtual tours may not reflect changes or conditions present after the service date.

7. Intellectual Property
7.1 The Company retains all rights to the scanned data and deliverables unless otherwise agreed upon in writing.7.2 Clients are granted a limited license to use the deliverables for their intended purpose only.

8. Confidentiality
8.1 The Company will maintain the confidentiality of any sensitive information provided by the Client.8.2 The Client consents to the Company using anonymized scans or images for marketing purposes unless explicitly stated otherwise.

9. Turnaround Time
9.1 The standard turnaround time for 3D scanning services is a maximum of 20 working days from the date of the scans completion, depending on the complexity and size of the project.9.2 For editing, additional services, or custom requests, the turnaround time will be determined based on what is mutually agreed upon in writing between the Company and the Client. This timeline will depend on the specific requirements and complexity of the project.9.3 The Company will make every reasonable effort to deliver within the specified timeframes but is not liable for delays caused by unforeseen circumstances, such as additional client revisions, technical issues, or factors beyond the Company’s control.9.4 All timelines are subject to what is deemed fit and fair for the nature of the project. The Company will communicate promptly regarding any potential delays or changes to agreed-upon schedules.

10. Dispute Resolution and Governing Law
10.1 In the event of a dispute, the parties agree to first attempt resolution through mediation.10.2 These T&Cs are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts located in [Insert Jurisdiction].

11. Force Majeure
11.1 The Company shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, government actions, labor disputes, or technical failures.

12. Acceptance
12.1 By booking services or renting equipment, the Client confirms acceptance of these T&Cs.
